Terms and conditions of booking and participation

Last update: 17 August 2026

1. Company identification

These Terms of Contract and Participation govern the services marketed by DMC PENINSULAR EVENTS S.L., company that owns the trade marks TOUR & FRIENDS and The Team Building Madrid (hereinafter, “the Company”).

These conditions apply to activities, experiences and services booked under any of such brands, unless different specific conditions are expressly established for a particular booking.

2. Object and scope

These terms and conditions govern the booking and provision of the activities, experiences and services offered by the Company.

They establish the rights and obligations of the Company, the contracting client and the participants, as well as the rules applicable during the development of the activities.

When making a booking, the customer declares that they have had access to these terms and conditions, have been able to read them before contracting, and accept them.

When a booking is made via a quotation or custom proposal, the specific conditions included in that quotation shall form part of the contract together with these conditions.

In the event of any contradiction between these terms and conditions and specific terms expressly agreed for a particular booking, the specific terms shall prevail in respect of what they specifically regulate, without prejudice to any mandatory rules that may apply.

3. Contracting client and participants

The contracting client it is the natural or legal person who makes the booking and contracts the services of the Company.

The participants they are the people who effectively participate in the contracted activities.

When the contracting client books an activity for a group, they must communicate the relevant instructions and conditions for participation to the participants.

In the case of bookings made by companies, schools, universities, agencies, associations or other organisations, the contracting client must provide the participants with the necessary information so that they can comply with these terms and conditions.

Where applicable, the contracting client shall be responsible for the obligations that legally correspond to them with regard to the members of their group.

4. Information provided by the client

The customer shall provide correct, complete and up-to-date information that is necessary to properly organise and provide the contracted services.

This may include, where relevant:

  • number of participants;
  • Ages;
  • accessibility requirements;
  • dietary requirements;
  • allergies;
  • mobility limitations;
  • special needs;
  • relevant characteristics of the group;
  • information required for certain activities.

The Company shall not be liable for the consequences arising from incorrect, incomplete or untimely information provided by the customer, to the extent that such consequences are not attributable to the Company and always within the limits established by applicable legislation.

5. Number of participants

The activities available for online booking may be booked in accordance with the participant range indicated for each activity.

The applicable participant range may vary depending on the type of activity, operational requirements, space capacity, supplier availability and other service characteristics.

For groups exceeding the range of participants available for online booking, the customer must contact the Company at:

info@tourandfriends.com
info@theteambuildingmadrid.com

or complete the corresponding contact form to request a personalised proposal.

If the number of participants exceeds the number confirmed in the booking, the Company cannot guarantee the availability of transport, spaces, restaurants, tickets, materials, equipment, guides, monitors or other services for the additional participants.

Additional participants may only join once the Company has previously confirmed their participation and the corresponding payment has been made.

The Company may refuse the addition of further participants when it is not reasonably possible to guarantee the capacity, safety, organisation or correct provision of the service.

6. Punctuality, lateness and non-attendance

Participants must arrive promptly at the meeting place and time indicated in the booking confirmation.

Delays may reduce the effective duration of the activity and shall not oblige the Company or its suppliers to prolong the activity to compensate for the lost time.

When the delay exceeds 30 minutes, or when the delay makes the correct provision of the activity or contracted services impossible or substantially impairs it, the Company may consider the reservation as a no-show and cancel the activity without the right to a refund when this is attributable to the customer or the participants.

Additional costs incurred as a result of delays by the client or participants, including additional transport, rebooking or other services, may be passed on to the client where applicable.

7. Activity modifications

The Company may reasonably modify the itinerary, order of activities, meeting points, timetables, duration or certain included services when necessary due to:

• public events;
• official ceremonies; demonstrations;
• access restrictions;
• closures of monuments or facilities;
• road closures;
• weather conditions;
• restrictions or instructions from the authorities;
• unavailability or changes of suppliers;
• transport incidents;
• security reasons;
• operational reasons;
• or any other circumstance beyond their reasonable control.

Whenever reasonably practicable, the Company will endeavour to offer a suitable alternative of a similar quality.

When a substantial modification affects the contracted service, the corresponding rescheduling, substitution or refund conditions shall apply in accordance with the Booking, Cancellation and Refund Policy and applicable legislation.

8. Safety and instruction compliance

All participants must follow the reasonable instructions provided by the Company, its guides, coordinators, supervisors, collaborators, and suppliers during the course of the activity.

Participants must correctly use any material, equipment or facility provided for the activity and respect the safety regulations established by the Company, the suppliers and the venues visited.

The Company may modify, suspend or terminate an activity when it reasonably considers that continuing it may endanger participants, staff, suppliers or third parties.

The Company and/or the supplier responsible for an activity may prevent or suspend the participation of any person whose behaviour, physical condition, consumption of alcohol or other substances, failure to follow instructions or any other circumstance may represent a risk to their own safety or that of other people.

Where the exclusion or suspension is the result of conduct attributable to the participant or group, there shall be no right to a refund, without prejudice to any rights that may legally apply.

9. Physical, medical conditions and special needs

Some activities may require certain physical conditions, mobility, coordination or the ability to perform physical exertion.

The participant is responsible for assessing, to the best of their ability, whether they can safely take part in the booked activity.

Before the start of the activity, the participant must communicate any personal circumstance that could reasonably affect their ability to participate safely, when such information is relevant to the organisation or provision of the activity.

This may include, but is not limited to:

  • mobility limitations;
  • allergies;
  • dietary requirements;
  • accessibility requirements;
  • relevant physical injuries or limitations;
  • special needs.

Communicating a special need does not guarantee that the activity can be adapted. The Company will, where possible, inform about available alternatives.

When an accommodation is not reasonably possible due to the characteristics of the activity or the conditions of a supplier, the Company will notify the client as soon as possible.

10. Risks inherent in the activities

Some activities may involve inherent risks that cannot be completely eliminated even when carried out properly and following safety instructions.

Depending on the activity, these risks may include, but are not limited to:

  • walking on uneven terrain;
  • slips or trips;
  • blows;
  • physical exertion;
  • cycling journeys;
  • sports activities;
  • water sports;
  • contact with surfaces, objects or obstacles;
  • weather conditions;
  • behaviour of other participants;
  • and other risks inherent to the specific nature of the activity.

Participation in an activity does not imply that the Company assumes liability for damages that are the exclusive consequence of a risk inherent to said activity, of the participant's own action or omission, of the failure to comply with safety instructions, or of circumstances for which the Company bears no legal liability.

The foregoing does not limit or exclude the liability legally corresponding to the Company for its own acts or omissions, negligence, breach of contract or any other legally attributable cause.

11. Accidents, injuries and liability

The Company carries out its activities with the aim of providing a safe and quality experience and will adopt the corresponding reasonable measures within the scope of its responsibilities.

However, the Company shall not be liable for any damage or injury resulting exclusively from:

  • risks inherent to the activity;
  • acts or omissions of the participant;
  • breach of instructions;
  • incorrect use of materials or equipment;
  • reckless or negligent conduct of the participant;
  • actions of third parties for which the Company is not legally liable;
  • unforeseeable or unavoidable circumstances beyond their reasonable control.

This provision does not exclude or limit any liability that may legally fall upon the Company for its own acts or omissions.

12. Activities and services provided by specialised suppliers

Some activities or parts of an experience may be provided entirely or partially by specialised and independent suppliers.

These may include, but are not limited to:

  • transport companies;
  • activity operators;
  • monitors;
  • instructors;
  • restaurants;
  • hotels;
  • museums;
  • monuments;
  • event spaces;
  • entertainment companies;
  • specialised operators.

When a supplier directly provides a service, that service will also be subject to the conditions, operating rules and security requirements established by the supplier.

Participants shall comply with the reasonable instructions of such providers during the provision of the service.

The Company shall be liable for any legal obligations and responsibilities that correspond to it in relation to the services it organises, coordinates or contracts.

13. Guides, monitors and collaborators

The Company may engage guides, monitors, instructors, coordinators, self-employed collaborators and other professionals to provide or coordinate the activities.

The instructions provided by these professionals in the exercise of their duties must be respected by the participants.

When an activity requires technical knowledge, specialised equipment or professional supervision, the Company may use specialised suppliers or professionals.

14. Damage to materials, equipment, vehicles and facilities

The client and/or participants shall be liable for any damage caused intentionally, negligently or through misuse to:

  • materials;
  • teams;
  • bicycles;
  • vehicles;
  • Facilities;
  • spaces;
  • furniture;
  • sports equipment;
  • electronic devices;
  • or other goods used during the activity,

when such damages are legally attributable to them.

In such cases, the Company or the affected provider may claim the reasonable and duly evidenced costs of repair, extraordinary cleaning or replacement when repair is not possible.

Normal wear and tear resulting from proper use, damage caused by pre-existing defects, or circumstances not attributable to the participant shall not be considered the responsibility of the participant.

15. Personal belongings

Each participant is responsible for their personal belongings throughout the entire activity.

The Company shall not be liable for the loss of, theft of or damage to personal belongings, except where these are the result of an act or omission legally attributable to the Company or to a person for whom it is legally responsible.

Participants should avoid bringing unnecessary valuables during the activities.

16. Alcohol and other substances

Alcoholic drinks will only be served to persons who meet the applicable legal minimum age.

Consumption of alcohol does not exempt participants from complying with safety instructions or the activity rules.

The Company or the relevant supplier may prevent or suspend the participation of any person whose state, due to the consumption of alcohol or other substances, could reasonably compromise their safety, that of other people or the proper running of the activity.

Where the exclusion is the result of conduct attributable to the participant, there shall be no right to a refund, without prejudice to any legally applicable rights.

Participants will remain liable for any damage caused by their conduct when such damage is legally attributable to them.

Minors and individuals requiring supervision

When minors or individuals requiring special supervision are participating, the contracting client and/or the person responsible for the group must ensure that adequate supervision is provided in accordance with the characteristics of the group and the activity.

When a minor participates unaccompanied by a father, mother or legal representative, the client must ensure that they have the corresponding authorisation from whoever legally exercises parental responsibility or guardianship, when such authorisation is necessary.

The Company may request, when necessary, information regarding the age of the participants, contact details of their parents, guardians or legal representatives, authorisations to participate and any other information reasonably necessary to ensure the proper organisation and provision of the activity.

Parents, guardians, teachers, group leaders or other persons in charge of supervision must report any circumstance relevant to the safety or participation of the minor.

When an activity has specific requirements regarding age, height, weight, physical condition, supervision, equipment, authorisation or participation, those requirements must be met.

For activities involving a high level of physical exertion, sports, water-based activities, adventure activities or any other specific risk, the Company may establish additional age, supervision or authorisation requirements in accordance with the nature of the activity, the provider's conditions and applicable regulations.

The participation of minors does not exempt the Company or the suppliers from the legal safety and protection obligations applicable to them.

18. Accessibility and special needs

The Company will endeavour to accommodate accessibility needs communicated in advance, provided that this is reasonably possible and compatible with the characteristics of the activity and the suppliers involved.

The accessibility of spaces, monuments, transport, restaurants or other services depends in certain cases on third parties.

When an activity is not accessible or cannot be reasonably adapted, the Company will inform the customer when it becomes aware of this.

19. Weather and environmental conditions

The activities will take place normally when weather conditions are compatible with their safe and reasonable execution.

Rain or other normal weather conditions will not necessarily imply the cancellation of an activity.

When weather or environmental conditions could reasonably compromise the safety, viability or quality of an activity, the Company may modify, delay, suspend, reschedule or replace the activity.

Where applicable, the Bookings, Cancellations and Refunds Policy will apply.

20. Emergencies and assistance

In the event of an accident, illness, emergency or any situation that may endanger the safety of a participant or the group, the Company and/or its providers may take any necessary reasonable measures to protect the affected persons.

These measures may include contacting emergency services, medical assistance, authorities or other support services when necessary.

The participant and/or client must cooperate with the staff and provide the necessary information to properly manage an emergency situation.

21. Transport services

When transport is provided by an external company, the service will be carried out by the corresponding carrier in accordance with their own terms and legal obligations.

The Company may coordinate and book transport as part of the experience, but the physical operation of the vehicle shall be the responsibility of the transport provider.

Timetables and transport characteristics may be affected by traffic, traffic restrictions, breakdowns, delays, instructions from the authorities or other external circumstances.

22. Accommodation, restaurants, venues and other external services

When an experience includes accommodation, restaurants, event spaces, museums, monuments, shows or other services provided by third parties, such services shall be subject to the operating conditions of the respective provider.

The Company may act as the organiser and coordinator of such services.

The specific supplier conditions will be communicated to the customer when they are relevant to the booking.

23. Photographs and videos

During some activities, photographs or videos may be taken for purposes related to the organisation and documentation of the activity.

When the Company intends to use identifiable images of participants for promotional or commercial purposes, the corresponding consent will be requested where legally required.

Participants who do not wish to be included in audiovisual material intended for promotional purposes may notify the Company in advance.

24. Force majeure and circumstances beyond reasonable control

The Company shall not be liable for the inability, delay or modification of an activity when this is the consequence of unforeseeable or unavoidable circumstances that are beyond its reasonable control.

These circumstances may include, amongst others:

  • natural disasters;
  • extreme weather conditions;
  • fires;
  • floods;
  • pandemics or health emergencies;
  • wars;
  • terrorist attacks;
  • strikes;
  • riots;
  • government restrictions;
  • decisions of the authorities;
  • road closures;
  • widespread transport disruptions;
  • facility closures or unavailabilities;
  • or other similar extraordinary circumstances.

Where possible and reasonable, the Company will endeavour to offer an alternative or reschedule the activity.

The economic consequences of these situations will be governed by the Reservations, Cancellations and Refunds Policy and by applicable legislation.

25. Incidents and complaints

Participants must report any incident to the Company or the activity coordinator as soon as reasonably possible.

Communication during the activity will allow, where possible, investigation of the incident and the adoption of measures to resolve it immediately.

The lack of communication during the activity shall not in itself constitute a waiver of the rights legally belonging to the client or participant.

26. Customer liability for their group

When a booking is made by a company, school, university, agency, association or other organisation for a group of participants, the contracting client must cooperate with the Company in the proper organisation and development of the activity.

This includes, where applicable:

  • provide correct information on the number of participants;
  • communicate the conditions of participation to the group;
  • notify special needs;
  • appoint group leaders when necessary;
  • ensure that participants are aware of the relevant instructions;
  • and collaborate with the Company and its suppliers during the activity.

27. Prices and availability

The Company reserves the right to correct typographical errors, manifest pricing errors or any other inaccuracies published on its websites.

An online booking will only be considered confirmed when the corresponding payment has been successfully processed and the Company has sent the booking confirmation.

The specific economic conditions for groups and events booked via a quote shall be those indicated in the accepted proposal or quote.

28. Relationship with the Booking, Cancellation and Refund Policy

These Terms and Conditions of Contract and Participation are supplemented by the Reservations, Cancellations and Refunds Policy from DMC PENINSULAR EVENTS S.L.

Both documents form part of the conditions applicable to the booking.

The Reservations, Cancellations and Refunds Policy specifically regulates the procedures for booking, payment, cancellation, refund, modification and rescheduling.

29. Applicable legislation and statutory rights

Contractual relationships shall be governed by the applicable Spanish legislation.

When the customer has the legal status of a consumer, the rights granted to them by applicable mandatory regulations shall be respected in all cases.

Nothing in these terms is intended to exclude or limit rights that cannot lawfully be excluded or limited.

30. Acceptance

Before completing an online booking, the customer must have access to these Terms and Conditions of Contract and Participation and expressly accept their content.

Acceptance of these conditions implies that the customer declares having had the opportunity to familiarise themselves with them before making the booking.

In electronic procurement processes, the Company shall retain the information necessary to verify the contracting and acceptance of the applicable conditions.
